General Terms and Conditions of Personal Data Protection (in accordance with GDPR (EU) 2016/679)
General provisions
1. These general terms of protection of personal data (hereinafter: General conditions for the protection of personal data) refer to personal data that are found, and which are obtained through the use of the www.spectra-media.hr website and all its subdomains, as well as the service points of the company SPECTRA - MEDIA d.o.o. for private protection, production, trade and services, PIN: 18787082051, Zagreb (City of Zagreb, registered with the Commercial Court in Zagreb, under the company registration number (CRN): 080037070, processed, that is, collected and stored by the manager of the collection of personal data, the company SPECTRA - MEDIA d.o.o. za privatnu zaštitu, proizvodnju, trgovinu i usluge, PIN: 20342948082 (hereinafter: SPECTRA - MEDIA d.o.o."), from you as a data subject.
SPECTRA - MEDIA d.o.o., as a site service provider (www.spectra-media.hr), and as an authorized person of the Ministry of Environmental Protection and Green Transition for electrical and electronic waste recovery, and as a provider of waste collection, recovery and disposal services, technical testing and analysis, production of other machines for personal purposes, information society services, other waste processing activities, waste recovery activities, waste management mediation activities, waste transportation activities, waste collection activities, waste trading activities, waste disposal activities, waste management, testing activities and waste analysis, production of rubber and plastic products, production of household appliances, production of office machines and computers, production of electrical machines and devices, transportation of goods (cargo) by road, computer and related activities, publicity (advertising and propaganda), representation of foreign companies , construction, supervision and design, purchase and sale of goods, commercial mediation services in the country and abroad, road transport of goods, international transport of goods, rental of vessels for vacation and recreation (charter, cruising, etc.), private protection, installation and maintenance refrigeration and air conditioning equipment, mediation in real estate transactions, real estate business, as well as other registered activities, is committed to protecting your privacy and your personal data. Please read these General Terms of Personal Data Protection to better understand what data we collect from you and how we use that data.

3. Please read these General Terms of Personal Data Protection carefully. By providing your personal data through the pages and indicating your consent to these General Terms of Personal Data Protection through the pages, as well as by using the services provided by SPECTRA - MEDIA d.o.o., you confirm that you have read, understood and agree to these general terms of personal data protection, and you give your consent to the collection of personal data either through a web contact or through a form that you will fill out when using the services of SPECTRA - MEDIA d.o.o., all in accordance with these General Terms of Personal Data Protection.
4. If you do not agree with these General Terms of Personal Data Protection, leave and do not access or use the pages, and do not use the services provided by SPECTRA - MEDIA d.o.o.
5. All matters not specifically regulated by these General Terms of Personal Data Protection shall be subject to the General Terms of Use of Internet Sites, which are available here.
Changes to the General Terms of Personal Data Protection
6. SPECTRA - MEDIA d.o.o. can amend or supplement these General Terms of Personal Data Protection at any time by publishing the amended text on the pages. Amendments to the General Terms of Personal Data Protection shall enter into force immediately after their publication on the website.
7. As a data subject, you are responsible and obliged to review and study the applicable General Terms of Personal Data Protection that are available on the website before each provision of your personal data.
Personal data processed and use of personal data, as well as purpose of personal data storage
8. SPECTRA - MEDIA d.o.o. collects only personal data that are essential to achieve the purpose of collection referred to in item 10 of these General Terms and Conditions and to the extent necessary to achieve the stated purpose of collection.
9. SPECTRA - MEDIA d.o.o. collects the following personal data about data subjects in e-mail correspondence and on the website: name and surname, address, personal identification number, phone number, account number, biometric data received through the video surveillance system, data on legal representatives of commercial companies/associations (name, surname, address, social security number), geographical data (GPS data), phone number (private and/or business), e-mail address, data on how to use the site, Internet provider.
10. SPECTRA - MEDIA d.o.o. collects and uses personal data referred to in Article 10 of the General Terms and Conditions, namely: name and surname, address, personal identification number, for the purpose of creating a database of its users, for the purpose of issuing invoices, i.e. for accounting legal obligations, for the purpose of filling in Form EE1 (certificate on the handover of EE waste in the household); first name, last name, e-mail, address, place, postal code, country, phone number, PIN, purchase history of the services of the Data Controller, order number, IBAN, point of sale, name of the purchased product/service, time of advertised purchase/service, account number, purpose of use online shopping services; geographic data (such as GPS coordinates) in order to protect the property of SPECTRA - MEDIA d.o.o.; data received through the video surveillance system for the protection of the company's assets, as well as the protection and safety of clients and employees; data on legal representatives of companies/associations (name, surname, address, PIN) for the purpose of concluding contracts with companies/associations, and for the purpose of recording these contracts and accounting obligations, and phone number (private and/or business), e-mail the address is collected and used for possible contact with data subjects before and during the use of services; data about the way the pages are used, to the Internet provider in order to provide their services in a better, more precise and personal way, to analyze the quality of the content on the web pages and to improve the pages and their contents to further direct and adapt them to the audience that visits them. Based on this data, we find out which contents are the most popular among which audience.
Access to the website www.spectra-media.hr is free and no registration is required. Providing personal data is voluntary. We do not process more personal data than is really necessary for your participation in an activity on our pages.
11. SPECTRA - MEDIA d.o.o. undertakes to process the collected personal data fairly and legally for the purposes specified in item 10 of these General Terms and Conditions and, if necessary, will process them exclusively for purposes that are consistent with the purpose of collection.
Personal data storage period
12. Transaction data are stored permanently due to the legal obligation of the Controller in accordance with the applicable accounting regulations. As an exception to the above, information about the Data Subject’s IBAN is kept only until the execution of the transaction to the Data Subject’s account (IBAN) in order to fulfill the Processor's obligation to return the paid funds, after which the same information is deleted.
13. The personal data collected for the purpose of filling out Form EE1 (certificate on the handover of WEEE in the household) are kept permanently.
14. Personal data collected through cookies are stored permanently or until the account of the user (Data Subject) is deleted.
15. In addition to all of the above, identification data, contact data and data on transactions made through the site and data on orders are also processed by the Controller for the purpose of fulfilling its legal obligations, including but not limited to legal obligations based on accounting and bookkeeping regulations or regulations on protect consumers.
16. Personal data collected for the purpose of resolving consumer complaints are kept for one year from the date of receipt of the consumer's (Data Subject’s) complaint, and in case of initiation of any of the procedures before the competent authorities, until the end of the legal remedy procedure.
17. In other cases, personal data collected is stored for the period prescribed by law.
Data protection officer, procedure in case of violation
18. Information about the data protection officer is publicly published on the website of SPECTRA - MEDIA d.o.o.
19. In the event of a breach of personal data, the controller shall notify the supervisory authority (Personal Data Protection Agency) and the data subject themselves of the breach without undue delay and, if feasible, no later than 72 hours after becoming aware of the breach, unless it is likely that the breach of personal data will cause a risk to the rights and freedoms of individuals. If reporting is not done within 72 hours, it will be accompanied by reasons for the delay.
Violations are considered to cause physical, material or non-material damage to an individual, such as loss of control over personal data or restriction of their rights, discrimination, identity theft or fraud, financial losses, unauthorized reverse pseudonymization process, damage to reputation, loss of confidentiality of personal data protected by business secrecy or any other economic or social harm to the individual concerned.
The controller is not obliged to notify the supervisory authority if they can prove, in accordance with the principle of responsibility, that the breach of personal data is unlikely to cause a risk to the rights and freedoms of individuals.
Provision of personal data
20. By providing your personal data based on these General Terms and Conditions of Personal Data Protection, you are informed that we provide such personal data to third parties for the purpose of fulfilling our legal rights and obligations, namely: tax returns, debt collection and other enforcement procedures, for the purposes of inspections.
21. Data subjects are informed that SPECTRA - MEDIA d.o.o. has a legitimate interest and legal obligation to submit their personal data to competent authorities in connection with committed traffic/parking violations/criminal offenses.
22. Based on its legitimate interest, the company may share your personal data with third parties in accordance with the contractual obligations it has with them, and in order to fulfill the obligations it has towards the Data Subject. Such business partners of the Controller belong to the following categories of recipients of personal data: companies for maintaining business systems, companies for maintaining services for sending e-mail messages.
23. Any other provision of personal data to third parties may be carried out exclusively in accordance with the legal regulations governing the protection of personal data.
Additions and corrections of personal data, the right to be forgotten
24. SPECTRA - MEDIA d.o.o. believes that every data subject should be able to ensure that their personal data are accurate, complete and up-to-date. If you believe that your personal data are incomplete, incorrect or out of date, please contact us by sending an e-mail to: gdpr@spectra-media.hr, and request the appropriate addition, modification or deletion of personal data.
25. We recommend that you update your personal data as soon as possible when they change. You can request the deletion or removal of your information.
26. The data subject has the right to request the controller for access to personal data and correction or deletion of personal data or restriction of processing relating to the data subject or deletion of personal data or restriction of processing relating to the data subject or the right to object to such processing and the right to data portability.
Data protection
27. SPECTRA - MEDIA d.o.o. takes data protection seriously and has taken various precautions to protect your personal data. The data subject’s personal identification information is stored on a server that can only be accessed by selected individuals and service providers, to ensure that the data subject’s personal data are secure.
28. Unfortunately, no data transmission over the Internet or any wireless network can be 100% secure, and SPECTRA - MEDIA d.o.o. cannot guarantee the protection of any information transmitted to or from the site and is not responsible for the actions of any third party to whom such data become available.
29. The computer equipment on which data are stored is located in premises to which access to unauthorized persons is prohibited outside working hours. Each employee is enabled, under their unique password, to process data by entering them into the database, using them or processing them in some other manner. Personal data that will be stored during work on the computer infrastructure will be deleted or destroyed as soon as they are no longer necessary to perform the work. In order to delete data from the media on the computer, deletion method will be used that will make it impossible to restore all or part of the deleted data.
33. Access to the software is protected by a special password. Employees have access to the software for the purposes of performing regular business activities. Employees are enabled to process data under the password of the software, by entering it into the database, using it or processing it in some other manner. Data sent by e-mail are stored on a secure server.
30. Data subjects are hereby also informed that SPECTRA - MEDIA d.o.o. stores personal data in material form in an archive located at the premises of the company, that it is protected in such a way that only selected persons can access it, and that it is protected from external influences. The rooms are locked outside of working hours or in a situation where there is no authorized person in the room.
Confidentiality of third-party data
31. These general terms and conditions of personal data protection refer only to the use and utilization of data that SPECTRA - MEDIA d.o.o. collects from data subjects. Other Internet sites that can be accessed through the sites have their own privacy and data collection statements and how they are used and published thereon. If you visit any such site, we encourage the user to review that site's privacy statement. SPECTRA - MEDIA d.o.o. is not responsible for the methods and terms and conditions of third parties.
Limitation of liability 32. Although SPECTRA - MEDIA d.o.o. takes all available technical, organizational and personnel measures to protect personal data from accidental or intentional misuse, destruction, loss, unauthorized change or access, we cannot guarantee that some of the personal data we collect will never be accidentally disclosed, contrary to the provisions of this Privacy Policy. To the maximum extent permitted by law, liability for damage incurred to users or third parties by accidental disclosure of personal data is excluded. Since SPECTRA - MEDIA d.o.o. has no control over the personal data submitted by data subjects when accessing or using other portals, i.e. directly submitted to third parties (e.g. when participating in sponsored activities), responsibility for damage that may be incurred to the data subject or third parties due to provision of personal data in this manner is excluded.
Other data
33. For the purpose of analysis of our pages, we use analytics software with which we analyze the use of the pages and thereby gain valuable knowledge about the needs of our users, with the aim of improving the quality of our offer. In this regard, the so-called cookies are used. Cookies are text files that are stored on the computer of site visitors. They enable user recognition when repeatedly visiting the page. This enables us to perform the usage analysis described above. Cookies can normally be rejected or deleted through the appropriate settings on the browser, but this may lead to the inability to fully use some of the functions of our pages. The mentioned software also collects and stores some technical data, including the user's IP address. We emphasize that under no circumstances will the persons behind these data be identified or personal data collected. These data are also not linked to personal data that the user may have disclosed. By using these pages, you grant your consent to the above-described manner of conducting the analysis of the use of these pages.
